Terms of use

These terms cover bumpmerch.com, run by Bumpsale. They're written to be read, not to be survived. If anything here is unclear, ask us and we'll explain it in plain words.

The one thing to understand first

When you buy from a drop, you're buying from the seller who ran it, not from bumpmerch. Their own Stripe account takes your payment, and the money sits with them from the moment you're charged. bumpmerch provides the software: the rising price, the production goal, the emails, and the fulfilment plumbing. We never hold your money.

That matters most when something goes wrong, so it's said here rather than in a footnote: a refund comes out of the seller's balance, and we chase it on your behalf.

How a drop works

  1. The price rises with every order

    A drop opens at a low price, often a dollar, and goes up by a set amount with each order. The price you see on the button when you check out is the price you pay. Buying earlier costs less. That's the whole mechanism, and it's why a drop can start within almost anyone's reach.

  2. You're charged when you order

    Not later, and not on a schedule. Your card is charged at checkout, which runs on the Bumpsale engine and Stripe.

  3. Printing starts when the drop reaches its goal

    Nothing is printed up front. Each drop has a production goal: the number of orders that covers printing, shipping and fees. Until it's reached, your order waits. The goal is stated on the drop's page before you buy.

  4. If the goal is missed, everyone gets their money back

    When a drop ends below its goal, nothing is printed and every buyer is due a full refund of what they paid. We tell you, we tell the seller exactly who to refund, and we track each refund until it lands.

  5. Then we ask for your address

    Addresses are collected after the goal is reached, not at checkout, because until then there's nothing to ship. You'll get an email with a link to a short form.

Shipping

Drops are United States only for now, and we can only accept US shipping addresses.

Most drops include shipping in the price. Some sellers charge a flat US shipping fee separately, collected with your address after the goal is reached. When that applies, the exact fee is stated on the drop's page and in your receipt before you buy, never afterwards, and it can't be changed once your order exists.

If a separate fee goes unpaid, we send reminders over 14 days. After that the order can't ship, and the item price you paid is refunded.

Refunds and cancellations

You're due a full refund if the drop ends below its production goal, or if an unpaid separate shipping fee means your order can't ship. Because printing is made to order, a change of mind after printing has started can't be guaranteed; contact the seller, or us, and we'll do what we can.

Refunds come from the seller's Stripe balance and normally arrive within 5 to 10 business days. If yours hasn't arrived within 14 days, tell us and we'll chase it.

If you're the seller

You're responsible for what you sell: that you have the rights to the artwork, that the product is described honestly, and that it's legal to sell. You connect your own Stripe account, so you're the merchant of record and you handle tax on your sales.

The refund obligation is yours. If a drop ends below its goal, every buyer is due their money back out of your balance. Treat money from an unfinished drop as committed, not earned. Your dashboard shows that figure so it's never a surprise.

bumpmerch charges 20% of each sale, taken automatically at the time of the charge. Printing, shipping and Stripe's own fees are separate and are shown in the calculator before you launch. Events and festivals may also be quoted a one-time setup fee, invoiced directly and agreed in advance.

You can close a drop at any time before its goal is reached. Once printing has begun it can't be unwound.

Accounts and fair use

Keep your login details to yourself and tell us quickly if you think someone else has them. Don't use bumpmerch to break the law, infringe someone's rights, or interfere with the service for other people. We can suspend an account that does, and we'll explain why.

What we can and can't promise

We work hard to keep bumpmerch running, accurate and honest, and we fix problems quickly when you tell us about them. We can't promise the service is never unavailable, and parts of a purchase run on other companies' systems: the Bumpsale engine, Stripe, and the printer. To the extent the law allows, our responsibility is limited to the fees bumpmerch earned on the order in question. Nothing here removes rights you have under consumer law.

Changes, and how to reach us

If we change these terms in a way that affects you, we'll say so on this page and update the date at the top. Changes never apply backwards to an order you've already placed. These terms are governed by the laws of the State of California, with any dispute heard in Sacramento County.
